MFN Duty Rate (Most Favored Nation)
The MFN (Most Favored Nation) duty rate — designated "Normal Trade Relations" in U.S. law — is the Column 1, General duty rate in the HTSUS. It is the standard duty rate applied to goods from all WTO member countries with whom the United States maintains NTR status and serves as the baseline duty before any trade remedy surcharges are added.
In Detail
The MFN principle originates in Article I of the General Agreement on Tariffs and Trade (GATT): any trade concession granted to one WTO member must be extended to all WTO members on a non-discriminatory basis. The United States calls this "Normal Trade Relations" rather than "Most Favored Nation" to avoid the political connotation of favoritism, but the legal content is the same. MFN/NTR rates are applied to imports from the vast majority of U.S. trading partners.
MFN rates appear in Column 1, General of the HTSUS rate schedule and are the product of decades of multilateral trade liberalization through successive GATT rounds and the WTO — the Kennedy Round (1967), Tokyo Round (1979), Uruguay Round (1994), and subsequent bilateral and plurilateral negotiations. For most manufactured goods, MFN rates are relatively low, typically 0–7%. For agricultural products, textiles, apparel, footwear, and certain other sensitive sectors, MFN rates can be substantially higher.
The MFN rate is the baseline layer of the total duty calculation. Trade remedy tariffs — Section 301, Section 232, IEEPA, ADD, CVD — stack on top of the MFN rate. They do not replace it. Preferential rates under free trade agreements provide lower-than-MFN rates, down to 0%, for eligible goods from FTA partners. Column 2 rates apply in lieu of MFN rates for the handful of countries without NTR status — Cuba and North Korea for most goods, and Russia for certain products.
Classification Significance
The MFN rate is the first layer in any total duty calculation. Every other duty determination — preferential rate, trade remedy overlay, Column 2 alternative — is assessed relative to or on top of the MFN rate. Identifying the correct MFN rate for the classified HTS subheading is the foundation of accurate duty calculation, and it changes when subheadings are restructured in annual HTSUS updates.
